These Terms may be updated as the app changes.
Effective date: October 17, 2026 Operator: ShotWitness, operated by its owner ("ShotWitness," "we," "us," "our"). A ShotWitness company is being formed. When it is, it will take over these Terms and we will post an update. Contact: use the contact form at shotwitness.com/contact.
These Terms of Use ("Terms") are a legal agreement between you and ShotWitness. They apply to the ShotWitness website at shotwitness.com and shotwitness.app, the ShotWitness web app, the ShotWitness mobile apps, and any related features or content (together, the "App").
You accept these Terms by tapping "I Understand and Agree," or by accessing or using the App. If you do not agree, do not use the App.
You must be at least 18 years old and able to form a binding contract to use the App.
If you are under 18, you may use the App only:
A parent or guardian who allows a minor to use the App:
The App is not directed to children under 13.
The App lets you do the following:
The App does NOT:
Results such as "MATCH," "MISMATCH," "CAN'T READ," or "RETAKE CLOSER" only describe whether the text the software recognized resembles the text you entered. They are not a clinical determination.
Automatic fill-in ("auto-fill"). When the App fills fields from the same photo it is checking, it is partly comparing the label with itself. You must compare every auto-filled field against the actual order or prescription from your provider.
You agree that:
a. You will not rely on the App to decide whether to take, give, refuse, or change any medication or dose.
b. You will confirm every medication and dose with your doctor, nurse, pharmacist, or other licensed health care provider before taking or receiving it, whatever the App shows.
c. If anything looks wrong or uncertain, you will stop and ask your provider before the medication is taken or given.
d. You are responsible for:
e. You will follow all instructions from your health care providers and all rules of any facility where you receive care. This includes rules about photography and other patients' privacy.
f. You will not photograph other people, or other people's records or labels, without permission.
g. You are responsible for your device's security, its backups, and who can access it.
h. OCR can misread text. For example, it may drop a digit (reading "10 mg" as "1 mg"), confuse "mg" with "mcg," or misread decimal points or similar drug names. Curved bottles, glare, small print, poor lighting, damaged labels, handwriting, and non-English text all make errors more likely.
Nothing in the App creates a doctor–patient, pharmacist–patient, nurse–patient, or any other professional relationship. ShotWitness is not a health care provider, pharmacy, health plan, or health care clearinghouse. Any health-related information in the App is general information only.
The App is not cleared, approved, or authorized by the U.S. Food and Drug Administration (FDA) or any other regulator. The App is not intended for use in the diagnosis of disease or other conditions, or in the cure, mitigation, treatment, or prevention of disease. It is not intended for use by health care professionals as part of clinical care.
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the App for your own personal, non-commercial use, under these Terms.
You may not:
If you downloaded the App from Apple's App Store, that store's terms also apply. See Section 16.
As described in our Privacy Policy, the App is designed to keep your photos, people, and logs on your device, and we do not receive them. Optional accounts for syncing are planned but not yet available. If we turn them on, we will update these Terms and the Privacy Policy first.
You are solely responsible for backing up, protecting, and deleting your data. If you clear your browser storage, delete the App, lose your device, or reset it, your data may be lost permanently. We cannot recover it.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND. SHOTWITNESS, ITS OWNER, AND ITS FUTURE COMPANY AND THAT COMPANY'S MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS, AND SUPPLIERS (THE "SHOTWITNESS PARTIES") DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY. THIS INCLUDES ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND QUIET ENJOYMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
WITHOUT LIMITING THE ABOVE, WE DO NOT WARRANT THAT: (a) THE APP WILL CORRECTLY READ ANY LABEL; (b) ANY RESULT, INCLUDING "MATCH," WILL BE ACCURATE OR COMPLETE; (c) THE APP WILL DETECT ANY PARTICULAR ERROR; (d) THE APP WILL BE AVAILABLE, UNINTERRUPTED, SECURE, OR ERROR-FREE; OR (e) DATA STORED ON YOUR DEVICE WILL BE PRESERVED.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, AND SUBJECT TO SECTION 11:
a. NO INDIRECT DAMAGES. THE SHOTWITNESS PARTIES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES. THIS INCLUDES DAMAGES FOR LOST PROFITS, LOST DATA, OR COST OF SUBSTITUTE SERVICES, AND APPLIES TO ANY CLAIM ARISING OUT OF OR RELATING TO THE APP OR THESE TERMS, WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, PRODUCT LIABILITY, OR ANY OTHER THEORY, EVEN IF WE WERE TOLD SUCH DAMAGES WERE POSSIBLE.
b. NO LIABILITY FOR MEDICATION DECISIONS. YOU ACKNOWLEDGE THAT DECISIONS ABOUT TAKING, GIVING, OR REFUSING ANY MEDICATION ARE MADE BY YOU AND YOUR HEALTH CARE PROVIDERS, NOT BY THE APP. THE SHOTWITNESS PARTIES ARE NOT RESPONSIBLE FOR ANY SUCH DECISION, OR FOR ANY MEDICATION ERROR, ADVERSE REACTION, MISSED DOSE, OR DELAY IN CARE, WHETHER OR NOT THE APP DISPLAYED A "MATCH," "MISMATCH," OR ANY OTHER RESULT.
c. CAP. THE SHOTWITNESS PARTIES' TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE APP OR THESE TERMS WILL NOT EXCEED THE GREATER OF (i) THE AMOUNT YOU PAID US FOR THE APP IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (ii) FIFTY U.S. DOLLARS (US $50).
d. These limits are an essential part of the bargain between you and us. They apply even if a limited remedy fails of its essential purpose.
Nothing in these Terms excludes or limits:
If a court or arbitrator finds that part of Section 9 or 10 cannot be enforced, that part will be enforced to the maximum extent allowed, and the rest will stay in effect.
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
12.1 Informal resolution first. Before starting arbitration, you and we each agree to try to resolve the dispute informally for at least 60 days after written notice. Send notice through the contact form at shotwitness.com/contact. The notice must include:
12.2 Agreement to arbitrate. You are giving up your right to go to court. You and ShotWitness agree that any dispute, claim, or controversy arising out of or relating to the App or these Terms (a "Dispute") will be resolved by final and binding individual arbitration and not in a court of law. This includes Disputes about the scope, validity, or enforceability of this Section 12, except as stated in Section 12.5.
By agreeing to arbitration, you and we are each waiving the right to file a lawsuit in court and the right to have a judge or jury decide the Dispute. Instead, a neutral arbitrator will decide it.
In arbitration:
12.3 Rules and forum. The American Arbitration Association ("AAA") will administer the arbitration under its Consumer Arbitration Rules then in effect (available at www.adr.org). The Federal Arbitration Act, 9 U.S.C. § 1 et seq., governs this Section 12.
12.4 Exceptions. Either party may:
12.5 CLASS ACTION AND JURY TRIAL WAIVER. YOU AND SHOTWITNESS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION. The arbitrator may not consolidate claims of more than one person and may not preside over any form of class or representative proceeding. A court, not an arbitrator, decides whether this Section 12.5 is enforceable. If a court finds this class action waiver unenforceable as to a claim, that claim must proceed in court, not in arbitration, and the arbitration agreement will not apply to it.
12.6 Mass filings. If 25 or more similar arbitration demands are filed by or with the help of the same law firm or organization, they may be administered in batches under the AAA's Mass Arbitration Supplementary Rules.
12.7 Time limit. To the extent allowed by law, any Dispute must be filed within one (1) year after it arose, or it is permanently barred.
12.8 30-day right to opt out. You may opt out of this arbitration agreement by sending us a message through the contact form at shotwitness.com/contact within 30 days after you first accept these Terms. Start the message with "Arbitration Opt-Out" and include your name and a clear statement that you are opting out. Opting out does not affect any other part of these Terms.
12.9 Changes. If we change this Section 12 in the future, you may reject the change by contacting us through the contact form within 30 days after the change takes effect. In that case, the most recent version you accepted continues to apply.
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless the ShotWitness Parties from any claims, losses, liabilities, damages, judgments, penalties, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:
We may take over the defense of any matter that requires you to indemnify us, and you will cooperate with us.
These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-laws rules, except that the Federal Arbitration Act governs Section 12.
For any Dispute not subject to arbitration, you and we agree to the exclusive jurisdiction of the state and federal courts located in New Jersey.
We may change, suspend, or discontinue the App at any time. We may update these Terms. If we do, we will post the new version with a new effective date and, for material changes, ask you to accept again in the App. Continued use after that means you accept the change.
You may stop using the App at any time. Sections 3–6 and 8–17 survive termination.
If you downloaded the App from the Apple App Store:
